Terms of Service
These Terms govern access to and use of the IPAware website, console, and API services (“Services”). If you do not agree, do not use the Services.

1. Acceptance of Terms
By accessing or using the Services, you agree to these Terms and any policies referenced here (including our Privacy Policy). If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.
2. Eligibility
You must be at least the age of majority in your jurisdiction to use the Services. You may not use the Services if you are prohibited from doing so under applicable laws.
3. Accounts & Security
3.1 Account registration
You may need an account to access the console and obtain API keys. You agree to provide accurate information and keep it updated.
3.2 Credentials and account protection
You are responsible for maintaining the confidentiality of your credentials and API keys and for all activity under your account. If you suspect unauthorized access, notify us promptly.
3.3 Account roles
If your account supports multiple users, administrators are responsible for setting permissions and controlling access.
4. API Access, Keys & Usage
4.1 License to use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services and API solely for your internal business purposes or as permitted by your plan.
4.2 API keys
API keys are secret credentials. Do not share them publicly. You should store keys securely and rotate keys when needed.
4.3 “Unlimited” plans and fair use
If your plan includes “unlimited” requests, it means we do not charge per-request fees or overages under normal use. We may apply fair use, safety controls, and abuse prevention to protect Service integrity.
4.4 Rate limiting and reliability
We may enforce rate limits, throttling, or other technical measures to maintain performance and prevent abuse. We may also change the API (including endpoints and fields) in accordance with the Changes section below.
5. Acceptable Use
You agree not to misuse the Services. You must comply with applicable laws and regulations.
5.1 Prohibited activities
- Attempting to reverse engineer, copy, scrape, or extract the Services or datasets beyond normal API usage.
- Using the Services to facilitate unlawful surveillance, stalking, or harassment.
- Using the Services to create or enhance malicious software, spam operations, or credential stuffing.
- Attempting to bypass rate limits, access controls, or abuse protections.
- Reselling or sublicensing the Services unless explicitly permitted in writing.
5.2 Responsible usage
You should use IP intelligence as one signal among many. You are responsible for your own downstream decisions and compliance (including any end-user notices/consents required for your use case).
6. Data, Privacy & Security
6.1 Privacy
Our handling of personal information (if any) is described in our Privacy Policy. You are responsible for maintaining your own privacy notices and lawful basis for processing when you send IP addresses or other data to the API.
6.2 Data retention
We may retain limited logs for security, abuse prevention, and operational purposes. Retention periods and details should be documented in your Privacy Policy and/or a dedicated data processing addendum if you offer one.
6.3 Security
We implement reasonable safeguards designed to protect the Services. However, no system is perfectly secure, and you agree to use appropriate security practices (e.g., key management, least privilege, secure storage).
7. Plans, Billing & Taxes
7.1 Subscriptions
Paid plans are billed in advance on a recurring basis (monthly or yearly, as selected). Your subscription renews automatically unless you cancel before renewal.
7.2 Fees and taxes
Prices are shown excluding taxes unless otherwise stated. You are responsible for applicable taxes, duties, or levies imposed by authorities, except for taxes based on our income.
7.3 Cancellations
You can cancel from your console. Cancellation stops future renewals; your plan typically remains active until the end of the current billing period.
7.4 Refunds
Unless required by law or stated otherwise, fees are non-refundable.
8. Third-Party Services
The Services may integrate with or link to third-party sites or services. We are not responsible for third-party content or practices, and your use of third-party services may be governed by their terms.
9. Intellectual Property
9.1 Our IP
The Services, software, documentation, and branding are owned by IPAware and/or its licensors and are protected by intellectual property laws. These Terms do not grant you any ownership rights.
9.2 Your content
You retain ownership of your content. You grant us a limited license to process data you submit to provide and secure the Services.
9.3 Feedback
If you provide feedback, you grant us the right to use it without restriction or compensation.
10. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Services will be uninterrupted, error-free, or perfectly accurate. IP intelligence may be incomplete, approximate, or outdated.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IPAWARE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO IPAWARE FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. (IF YOU USE THE FREE PLAN, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.)
12. Indemnification
You agree to defend, indemnify, and hold harmless IPAware, its affiliates, and their directors, officers, employees, and agents from and against claims, damages, liabilities, and expenses arising from your use of the Services, your violation of these Terms, or your violation of applicable laws.
13. Suspension & Termination
We may suspend or terminate your access to the Services immediately if we reasonably believe you violated these Terms, used the Services in a way that creates risk to others, or attempted to abuse or compromise the Services.
Upon termination, your rights to use the Services cease, but sections that by their nature should survive will survive (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification).
14. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, via the website or console). Your continued use of the Services after changes become effective constitutes acceptance.
15. Governing Law & Disputes
These Terms are governed by the laws of State of Delaware, without regard to conflict of laws principles. Any disputes will be brought in the courts located in State of Delaware, unless required otherwise by applicable law.
